Terms and Conditions of Service
Welcome to The Modern Touch Furniture. By placing an order with us, you (the Client) agree to the following terms and conditions. These terms are designed to ensure a transparent, professional, and high-quality experience for both parties.
1. Customization and Production Specifications
Since we specialize in bespoke furniture for cafes, restaurants, and hotels, every order is manufactured based on the specific instructions provided by the client.
Material Selection: We use the exact wood type (Sheesham, Acacia, Mango, Teak, or Pine) as finalized in the deal.
Dimensions: Clients must approve final dimensions before production begins. Small variances (up to 0.5 inches) may occur due to the handcrafted nature of the products.
Finishing & Upholstery: We provide finishes (Matt, Glossy, Semi-glossy) and fabric ranges as per the client's selection. Please note that wood grain patterns and fabric shades may vary slightly due to natural characteristics and batch differences.
2. Quality Assurance & Standards
At 'The Modern Touch Furniture', we maintain a strict quality protocol:
We use high-resilience 40-density foam for all sofa and chair upholstery to ensure longevity in high-traffic commercial environments.
Our signature double-coat sealer and lacquer finish is applied to all wooden surfaces for enhanced durability.
Our experienced labor force conducts a multi-stage quality check during the manufacturing process.
3. Payment Terms
Advance Deposit: A mandatory advance payment (as specified in the quotation) is required to initiate the production process.
Balance Payment: The remaining balance must be cleared before the dispatch of the goods from our Jodhpur facility.
Taxes: All prices quoted are exclusive/inclusive of GST as per the final invoice.
4. Lead Time and Delivery
Timelines: We pride ourselves on timely delivery. The estimated production time starts from the date of the advance payment and finalization of all designs.
Delays: While we strive to meet every deadline, 'The Modern Touch Furniture' is not liable for delays caused by unforeseen circumstances such as natural disasters, labor strikes, or raw material shortages.
Logistics: We facilitate transportation services across India. Shipping costs are to be borne by the client unless stated otherwise in the contract.
5. Packaging and Transit Risk
We ensure premium packaging using bubble wrap and heavy-duty corrugated boxes to minimize any risk of damage.
Once the goods are handed over to the third-party transportation service, the risk of transit damage lies with the carrier/client. However, we will assist in coordinating with the transporters for any claims.
6. Cancellations and Returns
Non-Refundable: As we manufacture custom-made items specifically for your project, orders cannot be cancelled or returned once production has commenced.
Replacements: In the rare event of a manufacturing defect, the client must notify us within 48 hours of delivery with photographic evidence. We reserve the right to repair or replace the defective piece at our discretion.
7. Jurisdiction
All transactions and agreements are subject to the legal jurisdiction of the courts in Jodhpur, Rajasthan.
